Hot Tub and Swimming Pool Permits

Hot tubs and swimming pools are regulated installations that may require permits and inspections. These requirements help ensure sage electrical connections, proper site placement, and appropriate safety measures. Understanding the permitting process early can help your project move forward smoothly.

When do you need a permit?

A building permit is required when you install, construct, or substantially modify a hot tub, spa, or swimming pool that is:

  • More than 600 mm (24") deep, or
  • Permanently installed in or on the ground, deck, or structure.

  • In-ground or above-ground swimming pools
  • Permanent hot tubs or spas
  • Pool decks, fences, and barriers related to the installation
  • Mechanical and electrical systems associated with pools or hot tubs

  • Portable or inflatable hot tubs that can be moved without tools
  • Temporary above-ground pools less that 600 mm (24") deep
How to apply?

You can apply online through eApply or in person at City Hall.

Your application should include:

  • Property address and description of work
  • Site plan showing pool or hot tub location and distances from property lines, buildings, and utilities
  • Construction details or manufacturer specifications
  • Fence and gate design, including height and latch information
  • Electrical permit number (if applicable)
  • Plumbing permit number (if applicable, for fill/drain connections

If your pool is in-ground, include cross-section drawings and structural details.

Permit Fees
  • Residential: minimum permit fee of $110.00 plus applicable Safety Codes Council levy.  Fees increase based on the total construction value.
  • Commercial: minimum permit fee of $250.00 plus applicable Safety Codes Council levy.  Fees increase based on the total construction value.
  • Additional fees may apply for trades (plumbing, electrical, HVAC), or re-inspections
Inspections

Inspections are required at key stages of construction:

  • Rough-in (if any structural or plumbing work is to be concealed)
  • Final (after installation and fencing are complete)

All work must be inspected by a Safety Codes Officer before the pool or hot tub is used.

FAQ's

  • The entire area of an outdoor swimming pool or hot tub must be protected by an enclosure with a minimum height of 1.8m (5'11") above ground.
  • Access through the fence must be protected by a lockable, self-closing gate the same height as the fence, with a self-latching device on the inside of the gate not less than 1.5m (4'11") above ground.

OR

  • Provide a cover that has been designed and constructed in conformance with ASTM F 1346, "Safety Covers and Labelling Requirements for All Covers for Swimming Pools, Spas and Hot Tubs" and is provided with lockable devices to prevent access to the water by unauthorized persons.

If the pool is deeper than 600mm, a compliant fence or barrier is required, even if its temporary.

Yes.  Most hot tubs and pools require a building permit and an electrical permit for pumps, heaters, or lighting.

Yes.  Homeowners can install their own hot tubs if they follow code requirements and obtain all necessary permits.
