Compliance Letters
A Compliance Letter states whether a property complies with the setback requirements of the Land Use Bylaw.
Requesting Records
A Compliance Letter is typically provided to a homeowner, realtor, lawyer, surveyor, or person involved in a real estate transaction. You can use eApply to submit a request for a Compliance Letter.
To request a Compliance Letter, an applicant must:
- submit a complete Real Property Report (RPR) that has been prepared by a licensed and certified land surveyor;
- pay the application fee (see below for fee schedule).
Once the application is received, Planning & Design will check the RPR to make sure it:
- complies with the rules of the applicable land use district as outlined in the Land Use Bylaw;
- has obtained necessary permits for any buildings, structures and/or improvements, shown on the RPR, that may exist on the property;
- has no outstanding encroachments of any development onto a City-owned property or a right-of-way that would affect the City.
Preparation of Records
Based on the findings from the review of the RPR, a Compliance Letter will either state that the property is compliant, non-conforming for setbacks for use of the parcel, or non-compliant. In the case of non-compliance, the letter may include:
- any development waivers or permits that must be obtained;
- recommendations on how to bring any deficiencies into compliance;
- instructions on how to apply for an encroachment agreement, if required.
Regular requests are typically fulfilled within 3 business days. Rush requests are completed within 1 business day. To request an updated letter, the previous letter must not be older than 12 months, otherwise a new letter is required.
